Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your access to and use of Torva's website, scanning services, and related software (the "Service"), operated by Torva LLC ("Torva," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you're agreeing on behalf of an organization, you represent that you're authorized to bind it.
2. What Torva is, and is not
Torva performs automated security scanning that identifies known vulnerabilities and misconfigurations. The Service is not a manual penetration test and does not guarantee that any system is secure or free of vulnerabilities. Findings reflect the state of a target at the time of a scan. You remain responsible for securing your own systems.
3. Authorization to scan — your responsibility
You may submit a domain, host, or network for scanning only if you own it or are expressly authorized by its owner to have it scanned. Before any paid scan runs, you must verify control of the domain through the methods we provide. You represent and warrant that you have all necessary authorization for every target you submit, and you are solely responsible for any scan you initiate. You agree not to use the Service to scan any system you are not authorized to test.
4. Acceptable use
Your use of the Service is also governed by our Acceptable Use Policy, which is incorporated into these Terms. Violation may result in immediate suspension.
5. Accounts
You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. Notify us promptly of any unauthorized use.
6. Plans, billing, and cancellation
Paid plans are billed monthly in advance through our payment processor, Stripe. Fees are non-refundable except where required by law. You may cancel at any time; your plan remains active through the end of the current billing period. We may change prices with notice; changes apply to your next billing cycle.
7. Torva Core
If you use Torva Core, you are responsible for installing the agent only on systems you control, for the scope you configure, and for the actions of anyone you allow to administer it. Core scans only the devices and ranges you approve.
8. Intellectual property
Torva and its licensors own the Service and all related software, content, and trademarks. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. Reports we generate for you are yours to use within your organization.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will detect all vulnerabilities or that results will be error-free.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TORVA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR BUSINESS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE [TWELVE] MONTHS BEFORE THE CLAIM.
11. Indemnification
You will indemnify and hold Torva harmless from claims arising out of your use of the Service, your submission of any target for scanning without proper authorization, or your violation of these Terms or applicable law.
12. Termination
We may suspend or terminate access for violation of these Terms, for unauthorized scanning, or as needed to protect the Service or others. You may stop using the Service at any time.
13. Governing law
These Terms are governed by the laws of the State of [Indiana], without regard to conflict-of-laws rules. [Dispute resolution / venue / arbitration clause to be added by counsel.]
14. Changes
We may update these Terms. Material changes will be posted here with a new effective date; continued use means you accept them.
